Bauer, Silvia and Ciccarillo concentrates in all employment and
labor law matters from both the employer and the employee perspectives.
This includes representation in grievance arbitrations, including
terminations, interest arbitrations, and negotiations involving
collective bargaining (union contracts), and severance agreements.
We have represented both public and private sector employers,
as well as individual employees, in various Commission on Human
Rights and Opportunities (CHRO) proceedings and state and federal
civil suits and jury trials which have alleged race, disability,
sexual orientation discrimination and sexual harassment. We also
counsel and advise on a broad range of topics including employee
misconduct investigations, family and medical leave (FMLA), discrimination
(including ADA, sexual harassment, sexual orientation and civil
union issues, EEOC, etc.) reasonable accommodation, wage and hour
issues, drug testing, Freedom of Information Act (FOIA), workplace
violence, employee privacy, and unemployment compensation.
We provide training and seminars on disability discrimination,
sexual harassment, and prohibited discrimination generally, as
well as on the appropriate and legal disciplining of employees
in the context of just cause, anti-discrimination, and reasonable
accommodation requirements of both union contracts and regulatory
statutes. We frequently review and update personnel policies and
handbooks, and counsel employers and employees on severance arrangements.
